Michael P. Ditka appeared with his lawyer in a Waukeagan court room on Wednesday and filed several motions attempting to clear him of the recent DUI charge.
Son of the former Bears coach, Ditka was arrested for DUI after Deerfield police said they found him with his Hummer running in the parking lot of the apartment complex where he lives, the Chicago Tribune reports.
Ditka had problems completing the field sobriety test and had a blood alcohol level of 0.189 percent, over the legal limit of .08 percent, police said. The passenger with Ditka evidently told police Ditka had been at the wheel when the car pulled into the parking lot of Deerfield Village Apartments.
Ditka and his attorney, Robert Ritacca, deny the charges, claiming Ditka was sitting in the car having a cigarette, but keys were not in the ignition. Ritacca also asked if Deerfield police had authority to be in the parking lot and make an arrest.
Judge Raymond Collins is allowing Ditka to continue to drive, but he will have to submit to random drug and alcohol testing.
Ditka is scheduled to return to court June 24.
