An Indiana couple charged with the abuse and murder of 13-year-old Christian Choate has been given a date for divorce.
A Lake County Circuit Court magistrate will hear the divorce case of Riley Choate and Kimberly Kubina on Dec. 20, according to the Northwest Indiana Times.
Choate, 39, and Kubina, 45, are both charged with murder, battery, neglect of a dependent and criminal confinement in the death of Choate's son, Christian. Kubina is the boy's stepmother.
Christian Choate's body was uncovered in May behind his deceased grandmother's mobile home in Gary, Ind. Authorities believe he died in April 2009 after suffering years of abuse and even being kept in a dog cage secured with seven locks.
Riley Choate reportedly filed for divorce Aug. 5. The estranged couple sits in the Lake County Jail, waiting for a Sept. 8 bail hearing.
