A northwest suburban man faces up to seven years in prison after admitting to fatally punching his father for walking in on the man's girlfriend in the bathroom, the Kane County state’s attorney says.
Daniel M. Rak, 31, of the 13N block of Engel Road in Burlington Township, was convicted of aggravated domestic battery Tuesday.
Prosecutors said Rak struck his father, Jeffrey Rak, multiple times in the face and head in February, breaking his nose at the home they shared. After one of the blows, the elder Rak yelled “My nose!” according to prosecutors.
“Daniel Rak later acknowledged that he saw blood coming from his father’s nose, and that for two days after his father continued to hold a rag to his nose,” the state’s attorney’s office said in a statement.
Daniel found his unresponsive father about 3:30 a.m. on Feb. 14 on the floor of the home’s downstairs bedroom and called 911, the state’s attorney’s office said. When emergency responders arrived, Jeffrey Rak was unresponsive and his face showed bruising and swelling and there was dried blood on his face, according to the state’s attorney. He was pronounced dead shortly after.
Daniel Rak told police he was angry and hit his dad because he walked in on his girlfriend in the bathroom, prosecutors said.
Kane County State’s Attorney Joe McMahon said the jury listened to and observed evidence and testimony in the case for six days.

“Domestic violence is at the root of far more deaths than most people realize,” he said in a statement. “Regardless of what fuels their violence, domestic abusers must be held accountable.”
Rak is free on his promise to appear in court at his next hearing on July 28.
