Dionte Johnson, one of four suspects convicted in the fatal 2006 beating of 16-year-old Fenger High School honors student Derrion Albert, was arrested on a gun charge on Sunday.
A Cook County Criminal Court judge ordered on Monday that Johnson remain in jail without bond.
Johnson was the youngest of four suspects convicted of Albert's murder. He was sentenced as a juvenile with the stipulation that if he was arrested again, it would trigger a new 30-year sentence.
Johnson was convicted of a crime in 2016, but then newly-elected Cook County State's Attorney Kim Foxx decided not to pursue the sentence.
At the time, she said in a statement, "based on a class 4 felony... it was not in the interest of justice to pursue a 30-year prison sentence."
On Monday evening, Albert's mother, who was prepared to forgive Johnson, was said to be so "distraught" she can't speak about the situation.
A spokesperson for the Cook County State's Attorney said that they agree with the bail that was set for the defendant.
