Woman Sues Grocery Store After Slipping on Vomit

A woman claiming she slipped on vomit and injured herself in a south suburban grocery store last year has filed a lawsuit against the store’s parent company. Ruth Luckett Toney was in the Ultra Foods at 13001 S. Ashland Ave. in Calumet Park on Aug. 26, 2013, when she slipped and fell on an “unnatural accumulation of vomit” on the floor of the produce section, according to the suit. Toney filed the suit in Cook County Circuit Court Friday against Ultra Foods’ parent company, SVC, LLC. The suit claims the store was negligent for failing to clean up the vomit when it presented a slipping hazard for customers. The suit is seeking a total of more than $50,000 in damages. A representative for SVT could not be reached for comment on the suit Friday afternoon.
